These terms and conditions together with the booking form comprise the agreement pursuant to which First Intuition provides classroom, online and distance learning courses and associated study materials to the customer.


1. Payment terms

1.1 Booking forms must be accompanied by payment in full or the employer’s authorisation to be invoiced directly.

1.2 Where the employer has agreed to pay, full payment must be made at the time of booking unless otherwise agreed with First Intuition.

1.3 First Intuition reserves the right to refuse admission to a course if full payment is not received prior to the course start date.

1.4 First Intuition reserves the right to charge late payment interest at a rate of 4% above the Bank of England base rate on any outstanding invoices.

1.5 First Intuition reserves the right to charge £50 for all dishonoured payments.

1.6 If an instalment plan has been agreed, the customer (who must be aged 18 or over) may be required to sign up to a direct debit scheme (depending on what centre you book with) or provide post dated cheques. Direct debit plans can only be accepted from customers with a UK bank account

1.7 All discounts and offers are mutually exclusive.  Only one offer can be applied per transaction.

1.8 All overseas sales will be subject to additional import duties if relevant.


2. Booking and registration

2.1 It is the responsibility of the person making the booking to ensure that the selected courses are appropriate for their needs.

2.2 Any change in the customers’ contact details must be notified in writing.

2.3 First Intuition does not accept responsibility for registering customers with professional bodies or entry for the relevant written exams.

2.4 Courses and study materials are not transferable between customers.


3. FI Classroom courses

3.1 Customers must bring the relevant course joining instructions to all course sessions. Failure to produce joining instructions or proof of payment upon request may result in customers being refused admission to a course.

3.2 First Intuition reserves the right to cancel, reschedule or change the location of a course without penalty if considered necessary. First Intuition undertakes to inform customers as soon as the change is made and customers may book an alternative course at no extra charge, or receive a full refund or credit against future courses.

3.3 Study materials will be provided on the first day of the classroom course.

3.4 If a customer wishes to cancel a course, provided more than 14 days notice prior to the course start date is given, the course fee will be refunded less a £100 cancellation fee. Any study materials already provided must be returned in unused re-saleable condition, otherwise these will be charged at full retail price.

3.5 If a customer wishes to transfer to another equivalent course for the same subject and the same exam sitting, provided there is availability, no additional charge will be made.

3.6 If a customer wishes to defer their course to a later exam sitting, provided more than 14 days notice prior to the course start date is given and subject to availability, the amount paid will be held as a credit on the customer’s account to be offset against the value of any future course booking. Any new study materials required will be charged at full retail price.

3.7 No refunds, transfers or deferrals can be made if less than 14 days notice is given.


4. Retake scheme (Pass Guarantee)
Students who meet certain conditions may be eligible to attend an equivalent FI Classroom or FI Online Live course free of charge in the event they do not pass their exam first time. Please check here for free retake eligibility criteria. In addition:

4.1 Any new or additional study materials will be charged at retail price.

4.2 Customers will be asked for proof of their exam results when making a claim.

4.3 The retake scheme is not transferable between customers.

4.4 The retake scheme is not transferable between subjects.

4.5 No cash alternative or refund will be given in the event that a customer is unable to attend an equivalent course for any reason.

4.6 Free Retake Scheme is not applicable to ICAEW courses.


5. ACCA and CIMA Online and Online Live courses

FI Online courses and resources

5.1 FI Online resources and study support will be provided for a period of 12 months from date of invoice or one exam sitting (written exam subjects/Case Study). Online access to our Case Study courses cannot be extended.

5.2 FI Online study materials may be collected in person or delivered to the customer’s preferred address. First Intuition must be notified of any queries, complaints, damage or short deliveries within 14 days of receipt of study materials, if a refund or replacement is required.

5.3 We require a minimum of 14 days notice prior to the course start date for cancellation. You will be entitled to a refund of all tuition fees invoiced, or the amount paid will be held as a credit on your account to be offset against the value of any future course booking, less an administration fee of £100. Please note you may be asked to return any study material in a re-saleable condition.

5.4 FI Online customers can switch to any relevant FI Classroom course, subject to availability, within 6 months of booking. Customers will be invoiced for the course fee less the amount paid in respect of the FI Online course, plus any new materials that may be required.

5.5 Materials and online access are provided for the syllabus valid at the time of purchase. Replacement or updated resources will be charged for.

Online ACCA/CIMA Unlimited study packs

5.6 Each CIMA Unlimited study pack will provide you with access to Unlimited online courses and study support for a period of 18 months. An ACCA Unlimited study pack for a single module will provide you with access to Unlimited online courses and study support for a period of 6 months, for the module that you have chosen. ACCA Unlimited study packs for 2 or 3 modules will provide you with access to Unlimited online courses and study support for a period of 12 months, for the modules that you have chosen. ACCA Unlimited study packs for 4 or more modules will provide you with access to Unlimited online courses and study support for a period of 24 months, for the modules that you have chosen. All ACCA Unlimited study packs will include access to an Online Final Self-Marked Mock. For a £20 supplement, you can upgrade from an Online Final Self-Marked Mock to a Online Final Marked Mock. What if you want to leave the ACCA/CIMA Unlimited programme early?

If for any reason you are not happy with the Unlimited package and wish to leave the programme before completing all papers within your package, within the agreed duration of your programme, we will charge the full retail price of the course(s) you have attended or accessed via the FI learn platform. If there is any balance remaining from the amount paid, we will refund this to you. Any material for units which have already been dispatched must be returned in a re-saleable condition within the 14 days of your cancellation for a full refund to be made. If any materials cannot be returned in a re-saleable condition these will be charged at full retail price. A £100 cancellation administration fee will also be applied to any cancellations of Unlimited packages. If the agreed duration for the programme has expired, a refund cannot be issued.  It’s really important to us that you are motivated and serious about qualifying, so we want our packages to be fair and transparent. 5.7 Physical study materials associated with online courses will be delivered to the customer’s preferred address. Course materials will be despatched at the point of each booking within the ACCA/CIMA Unlimited package. Delivery to overseas addresses will incur a shipping charge. First Intuition must be notified of any queries, complaints, damage or short deliveries within 14 days of receipt of study materials if a refund or replacement is required.

5.8 We care about the progression of our students and want every student to pass each exam first time. Students studying via CIMA Unlimited study packs can book courses for one module at a time. ACCA Unlimited students can book a maximum of two modules to a single exam sitting, irrespective of whether that is a first-time attempt or a retake.

5.9 Payment plans are available to students who have a UK bank account, otherwise upfront payment is required. The first instalment is made on booking, and the remaining payments will be taken on the same day each month thereafter to reflect the dates/amounts of the study pack chosen. If instalment payments cannot be collected as per the agreed payment schedule, FI reserves the right to remove access to online courses and tutor support until the payments are resumed.

For example, if you book an ACCA Unlimited 2 study pack in January 2023 on a 6 month payment plan, the first payment is due upon booking with the following payments taken thereafter: 1st February, 1st March, 1st April, 1st May and 1st June 2023.

5.10 We require a minimum of 14 days notice prior to the course start date for cancellation. You will be entitled to a refund of all tuition fees invoiced, or the amount paid will be held as a credit on your account to be offset against the value of any future course booking, less an administration fee of £100. Please note you may be asked to return any study material in a re-saleable condition.

5.11 If a student who is paying by instalments completes all papers included within a CIMA Unlimited study pack before the payment instalments have been completed, we will waive the remaining balance outstanding on your current payment plan upon the purchase of your next CIMA Unlimited study pack with FI. Otherwise, the payment plan will be collected as agreed at time of purchase.

5.12 Students who have purchased a CIMA Unlimited study pack can supplement their online learning with any relevant FI Classroom course (subject to availability). The Classroom course will be charged at list price less a discount of 20% arranged for students on a CIMA Unlimited study pack. This discount is only valid during the period of support offered by the CIMA Unlimited Study pack

5.13 Materials and online access are provided for the syllabus valid at the time of booking. Replacement or updated resources will be charged for.

5.14 The Unlimited programme (both ACCA and CIMA) are offered at a discounted price. Other discounts cannot be used in conjunction with this offer, unless otherwise previously agreed with FI.


6. AAT Distance Learning Courses

FI Online/FI Online Live
(Whole level sales)

6.1 The online resources and study support will be provided for each unit for an initial period of 6 months from online enrolment onto the unit. Study materials will be provided for the current AAT syllabus at the time of purchase and replacement material in respect of syllabus changes will be charged for. Once a student has achieved competency in their real assessment, no more support will be offered, although students will have access to the material up to the usual expiry date, being 6 months from the start of that particular unit.

6.2  FI Online study materials may be collected in person or delivered to the customer’s preferred address. First Intuition must be notified of any queries, complaints, damage or short deliveries within 14 days of receipt of study materials, if a refund or replacement is required.

6.3 If a customer wishes to cancel an online course, this must be done within 14 days of the original invoice date. Any material for units which have already been dispatched must be returned in a re-saleable condition within the 14 days for a full refund to be made. If any material cannot be returned in a re-saleable condition the full price of that unit will be deducted from the refund. After the 14 day period has passed, no refunds will be given and all instalments agreed upon at enrolment will be required to be paid.

6.4 FI Online customers can switch to any relevant classroom course, subject to availability, within 6 months of booking. Customers will be invoiced for the course fee less the amount paid in respect of the FI Online course, plus any new materials that may be required.

6.5 Study materials will be provided for the current AAT syllabus at the time of purchase and replacement material in respect of syllabus changes will be charged for. Existing students will continue to receive materials under their original syllabus registration unless new syllabus material is requested. From the AAT launch date of a new syllabus all new full level bookings will be for the syllabus unless notified otherwise.

6.6 Once a student has achieved competency in their real assessment, no more support will be offered, although students will have access to the material up to the usual expiry date, being 6 months from the start of that particular unit

FI Online/FI Online Live
(Single unit sales)

7.1 The online resources and study support will be provided for each unit for an initial period of 6 months from online enrolment onto the unit. Study materials will be provided for the current AAT syllabus at the time of purchase and replacement material in respect of syllabus changes will be charged for. Once a student has achieved competency in their real assessment, no more support will be offered, although students will have access to the material up to the usual expiry date, being 6 months from the start of that particular unit.

7.2 FI Online study materials may be collected in person or delivered to the customer’s preferred address. First Intuition must be notified of any queries, complaints, damage or short deliveries within 14 days of receipt of study materials, if a refund or replacement is required.

7.3 If a customer wishes to cancel an online course, this must be done within 14 days of the original invoice date. The material must be returned in a re-saleable condition within the 14 days, additionally the customer must not have accessed the online resources or attended any live online lectures in order for a full refund to be made. If material cannot be returned in a re-saleable condition no refund will be made. After the 14 day period has passed, no refunds will be given and all instalments agreed upon at enrolment will be required to be paid.

7.4  FI Online customers can switch to any relevant classroom course, subject to availability, within 6 months of booking. Customers will be invoiced for the course fee less the amount paid in respect of the FI Online course, plus any new materials that may be required.

7.5 Study materials will be provided for the current AAT syllabus at the time of purchase  and replacement material in respect of syllabus changes will be charged for. Existing students will continue to receive materials under their original syllabus registration unless new syllabus material is requested. From the AAT launch date of a new syllabus all new full level bookings will be for the new syllabus unless notified otherwise.

Self Study

7.6  Self study materials may be collected in person or delivered to the customer’s preferred address. First Intuition must be notified of any queries, complaints, damage or short deliveries within 14 days of receipt of study materials, if a refund or replacement is required.

7.7 If a customer wishes to have a refund for damaged self-study material, then the material must be returned within 14 days of the delivery date for a full refund to be made.

7.8 If a customer wishes to have a refund for reasons other than damaged material, we must be informed within 14 days of the date of purchase of self-study material. A full refund excluding any postage charges will be made.

7.9 Self customers can switch to any relevant FI Classroom or FI Online course, subject to availability, within 6 months of booking. Customers will be invoiced for the course fee, less the amount paid in respect of the self study material, plus any new materials that may be required.

7.10 AAT material is subject to syllabus changes every 3 years. It is the responsibility of the customer to ensure they are purchasing the correct version of material. If a customer wishes to return material for a different edition, this must be arranged within 14 days of receipt of the original delivery.

7.11 Study materials will be provided for the current AAT syllabus at the time of purchase  and replacement material in respect of syllabus changes will be charged for.


8. Computer Based Exams

8.1 Under no circumstances is the customer entitled to a refund of examination or associated administration fees.

8.2 If a customer wishes to defer their computer based examination then at least 5 working days notice must be given. A maximum of 2 deferrals will be permitted.

8.3 First Intuition reserves the right to charge an administration fee for exam deferrals.

8.4 First Intuition may charge an administration fee in addition to the published examination entry fee.

8.5 No refunds or compensation can be offered in the event that exams are cancelled or disrupted due to technical problems outside the control of First Intuition.


9. Oxford Brookes mentoring

9.1 Mentoring sessions must take place within 6 months of the invoice date.

9.2 First Intuition does not accept responsibility for customers who fail to submit their Project within the time specified by Oxford Brookes University or ACCA.


10. Intellectual property

10.1 All intellectual property rights in all materials and online resources supplied by First Intuition is expressly reserved. Any unauthorised duplication, publication or distribution is strictly prohibited.

10.2 The customer agrees to fully indemnify First Intuition in respect of any infringement of intellectual property right as contained in 10.1.


11. Liability

11.1 The liability of First Intuition for direct losses arising out of its negligence (other than in respect of liability for death or personal injury), breach of contract or any other cause of action arising out of or in connection with this agreement is limited to the value of monies received from the customer (or their employer) for the course.

11.2 First Intuition shall not be liable for any consequential or indirect loss, howsoever arising.


12. Security

12.1 First Intuition accepts no responsibility for anything that is lost or stolen from its premises. Personal possessions are the sole responsibility of the customer and customers are advised to keep valuable belongings with them at all times.

12.2 All payment information passed between our website and Sage Pay is encrypted using 128-bit SSL certificates. No cardholder information is ever passed unencrypted and any messages sent to Sage Pay are signed using MD5 hashing to prevent tampering. No customer data passed to Sage Pay servers can be examined, used or modified by any third parties attempting to gain access to sensitive information.


13. Data protection

13.1 Data provided to us is necessary in order to provide goods and services. First Intuition takes the security of customer details very seriously and we ensure that we meet our legal obligations as laid down by the Data Protection Act 1998.

13.2 The customer agrees to allow First Intuition to retain information and use it to:
– communicate with the customer to perform their obligations under this agreement;
– inform customers about their courses, products and services which may be of interest;
– provide feedback to customers on their progress and exam performance
– communicate with the customer’s employer regarding their progress, results and attendance.
– for AAT students, information may be shared with the awarding body for the qualification (AAT).

13.3 Customers have the right to receive details of personal information held about them. Full details can be found in our Privacy Policy.

13.4 Customers have the right to request erasure of their personal details. Please note First Intuition is required to keep information relating to financial transactions for six years. Full details can be found in our Privacy Policy.


14. Validity
If any provision of this agreement is held to be invalid or unenforceable the remaining provisions shall not be affected and shall be carried out as closely as possible according to the original intent.

15. Jurisdiction
This agreement shall be governed and construed in accordance with the law of England and the parties submit to the exclusive jurisdiction of the English courts for the determination of disputes arising under this agreement.
